Wisby AI LLC ("Wisby," "we," "us," or "our"), a Delaware limited liability company, operates the website at wisby.ai and provides software engineering services and engineering staffing to business clients. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have.
This policy applies to wisby.ai, to our email and other communications with you, and to personal information we handle in the course of providing our services. It does not apply to the internal systems of our clients, or to third-party websites we link to.
1. Who this policy covers
We handle personal information about several different groups of people, and what we collect differs by group:
- Website visitors — anyone browsing wisby.ai.
- Prospective and current client contacts — people at companies who contact us, whom we contact, or who work with us on an engagement.
- Candidates and engineers — people who apply to work through Wisby, are sourced by us, or are placed with our clients.
- Vendors and business partners — contacts at companies that provide services to us.
2. Information we collect
From website visitors
- Contact form submissions: name, email address, company name, and the contents of your message. Submissions are delivered directly to our email inbox.
- Technical and usage data: IP address, browser type and version, device type, operating system, referring URL, pages viewed, and the dates and times of your visits. This is collected automatically through cookies and similar technologies. See Section 5.
From client contacts
- Name, business email address, phone number, job title, and company.
- Correspondence with us, including emails, messages, and meeting notes.
- Contract, billing, and payment information, including billing contacts and remittance details.
From candidates and engineers
- Identity and contact details: name, email address, phone number, and location or time zone.
- Professional information: resume or CV, work history, education, skills, certifications, portfolio or code samples, links to public professional profiles, and references.
- Assessment information: interview notes, technical assessment results, and scorecards.
- Engagement information: your right to work, contracting model, availability, and rate expectations.
- If you are engaged by us, payment and tax information necessary to pay you.
We do not currently record interviews or technical assessments. We do not conduct background checks. If either changes, we will update this policy and obtain your consent before doing so.
We do not ask candidates for information about race, ethnicity, religion, health, sexual orientation, or other sensitive categories as part of the assessment process, and we ask that you do not include it in materials you send us.
3. Where we get information
We collect personal information:
- Directly from you, when you fill in our contact form, email us, speak with us, apply for a role, or enter into an agreement with us.
- Automatically, through cookies and analytics on our website.
- From third parties, including professional networking and job platforms, publicly available professional sources, business contact databases, recruiting and sourcing partners, referrals, and references you nominate.
- From our clients, where a client shares the details of a contact or an engagement with us.
4. How we use personal information
We use personal information to:
- Respond to enquiries submitted through our website or sent to us directly.
- Provide, staff, manage, and support our engineering services and staffing engagements.
- Evaluate candidates for suitability and present qualified candidates to clients.
- Negotiate, enter into, and administer contracts, including invoicing and payment.
- Send marketing and business development communications about our services, subject to the opt-out described in Section 8.
- Operate, secure, debug, and improve our website and systems, and analyse how the website is used.
- Detect, prevent, and respond to fraud, abuse, security incidents, and other unlawful activity.
- Comply with legal obligations and establish, exercise, or defend legal claims.
We do not use personal information to make decisions producing legal or similarly significant effects about you without human involvement. Candidate assessment decisions are made by our people, not automatically.
5. Cookies and analytics
We use cookies and similar technologies on wisby.ai. These fall into two categories:
- Strictly necessary cookies, which are required for the site to function and cannot be switched off.
- Analytics cookies. We use Google Analytics, provided by Google LLC, to understand how visitors find and use our site — which pages are viewed, how long visits last, and which sources refer traffic. Google Analytics collects your IP address and sets cookies on your device. Google's handling of this data is governed by the Google Privacy Policy.
We do not use advertising pixels, retargeting tags, or cross-site tracking technologies on wisby.ai.
Your choices. Most browsers let you refuse or delete cookies through their settings. You can also install the Google Analytics Opt-out Browser Add-on to prevent Google Analytics from collecting your data on any site. If you block strictly necessary cookies, parts of the site may not work as intended.
6. How we share personal information
We share personal information with:
- Clients. We share candidate profiles, resumes, and assessment results with clients considering that candidate for an engagement, and share engagement-related information with clients during delivery.
- Service providers. Companies that host our website and systems, provide email and calendaring, run our CRM and applicant tracking, process payments, provide analytics, and provide security services. These providers are permitted to use personal information only to perform services for us.
- Professional advisors. Lawyers, accountants, auditors, and insurers, where reasonably necessary.
- Corporate transactions. A buyer or successor entity in connection with a merger, acquisition, financing, reorganization, or sale of assets.
- Legal and safety. Law enforcement, regulators, courts, or other parties where we believe disclosure is required by law, or is necessary to protect the rights, property, or safety of Wisby, our clients, our people, or the public.
We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA) and similar state laws. We have not done so in the preceding twelve months.
7. How long we keep information
We keep personal information only as long as we need it for the purposes described above, and then delete it or de-identify it.
- Website contact form submissions: 24 months from last contact.
- Client contact and engagement records: for the term of the engagement plus 7 years, to meet contractual, tax, and legal obligations.
- Candidate records, where we do not place you: 12 months from your last activity with us, so that we can consider you for future roles. You can ask us to delete your record sooner at any time.
- Candidate and engineer records, where you are placed: for the term of the engagement plus 7 years.
8. Marketing emails and your opt-out
We send business development emails to work addresses of people at companies we believe may benefit from our services. Every marketing email we send includes an unsubscribe link. You can also opt out at any time by emailing hello@wisby.ai with "Unsubscribe" in the subject line, and we will remove you promptly.
Opting out of marketing does not stop transactional or relationship messages — for example, replies to your enquiry, contract correspondence, or messages about an active engagement.
9. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls limiting access to people who need it, and vendor due diligence.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law.
10. Your privacy rights
Depending on where you live, you may have some or all of the following rights:
- Know / access — to know what personal information we hold about you, where we got it, why we use it, and who we share it with, and to receive a copy.
- Delete — to ask us to delete personal information we hold about you.
- Correct — to ask us to fix inaccurate personal information.
- Portability — to receive your information in a portable format.
- Opt out of sale or sharing — we do not sell or share personal information, so there is nothing to opt out of, but you may confirm this with us.
- Non-discrimination — we will not deny you services, charge you a different price, or provide a lesser quality of service because you exercised a privacy right.
These rights are available to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws, to the extent those laws apply to us.
How to exercise your rights
Email hello@wisby.ai with the subject line "Privacy Request," and tell us which right you want to exercise. We will verify your identity before acting — usually by confirming information we already hold, such as the email address associated with your record. We will respond within 45 days, and may extend once by a further 45 days where the request is complex, in which case we will tell you.
An authorized agent may submit a request on your behalf with written authorization from you.
Appeals. If we decline your request, you may appeal by replying to our response with the word "Appeal." We will respond to appeals within 45 days. If we deny your appeal, you may contact your state attorney general.
California "Shine the Light"
California residents may request information about personal information we disclosed to third parties for those parties' direct marketing purposes. We do not make such disclosures.
11. Children
Our website and services are directed to businesses and working professionals, not to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us at hello@wisby.ai and we will delete it.
12. Where information is processed
We are a United States company and process personal information here. Some of our service providers and personnel may be located in other countries, in which case personal information may be transferred to, stored in, or accessed from those countries. Where we do so, we take steps to ensure the information receives a level of protection consistent with this policy.
13. Third-party links
Our website links to third-party sites, including our social media profiles. We are not responsible for the privacy practices of those sites. We encourage you to read their privacy policies.
14. Changes to this policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date at the top. If the changes are material, we will provide additional notice, such as by email or a notice on our website. Your continued use of our website after a change takes effect means you accept the revised policy.
